A Former Vice President of the Nigerian Bar Association, Barrister Monday Ubani has alleged that the Nigerian constitution since 1999 has never stopped the sworn-in of a President-elect because of the tribunal case in court.

He said in an interview with Arise Tv news that the Judicial process in part of the electoral process. He however stated that this judicial process has not been reviewed to end the proceedings before the inauguration of the President-elect. According to him, the position of the law states that the President-elect has to be sworn-in while the election cases are still in court.  CONTINUE READING>>

He said, ”We have the judicial sector in order to determine the finality of this process. The argument now is why don’t we finalize everything before the candidate is sworn in. But before now, the Nigeria law since 1999 has never stopped the sworn-in of a President-elect.

Now that this argument is coming, maybe the National assembly members will have to look at it and if there is wisdom that he must conclude the entire process with the judicial process before we can sworn in, maybe they can amend the law to accommodate that. But for now, the provision of the law is that you can declare the President-elect while the court process will have to be exhausted. That is the position of the law for now.”
