Source: FacebookComing days after the pastor moved to court to protest over the decision by a Nairobi court to freeze his bank accounts, the High Court declined to grant him access to the 15 bank accounts.

In her ruling in Mombasa earlier today, Osewe said she would not comment on the legality of the orders issued by a Nairobi Magistrate last week to freeze the account as her court had no jurisdiction, Citizen TV reported.

The judge ruled that before taking the matter of the TV licence to court, the petitioners should first address the issue with the Communications Authority of Kenya exhaustively before seeking legal channels.

She, however, allowed the application barring the police from interrupting his church services at his Kilifi Mavueni Church.

A week ago, the pastor’s lawyers moved to Mombasa High Court to seek conservatory orders preventing the state from freezing his bank accounts, closing his church in Mavueni, and suspending his TV station.

In their argument, lawyers Danstan Omari, Cliff Ombeta and Jared Magolo asked Lady Justice Olga Sewe to put on hold the orders issued by the Nairobi magistrate court on Monday, May 8.

They argued that it was unconstitutional and illegal for the state to freeze his accounts without giving him a chance to defend himself.

“It was unlawful for the state to move a court of lower jurisdiction to freeze our client’s accounts having a case going on in the high court. The pronouncements made are a threat to the constitutional rights of the respondent,” argued Omari.Omari says pastor Ezekiel can’t fulfil financial obligationsWhile addressing the press last week, Omari lamented that he and his colleagues who are representing the cleric were yet to receive their dues.
